Consumer Group Sues McDonald's Over Happy Meal Toys
 

Dear Child In The Back Seat: Your days of whining for the Strawberry Shortcake Happy Meal toy you saw on TV may be numbered. At least in California.

The Center for Science in the Public Interest filed a lawsuit today against McDonald's in state court in California to stop the company from advertising toys with Happy Meals.

It's no sure thing that the consumer group will get its way in court, of course, but the lawsuit ups the pressure on the fast-food chain over the combination of food and toys that appeal to kids. McDonald's defends the meals.


The group filed the class action suit on behalf of parents, including plaintiff Monet Parham, a 41-year-old mother of two from Sacramento who says she's fed up with the pestering.

"Happy meals are among the those things frequently requested, and the first thing they ask me to do is open the toy," Parham said in a press conference today. "I'm really concerned about the health of my children, and I don't think its OK to entice children to get Happy Meals with a toy," she added.

McDonald's didn't immediately return requests for comment about the lawsuit, although it has known that CSPI intended to file a suit since June.

The lawsuit asserts that under California's consumer protection laws, McDonald's toy advertising is deceptive. It targets children under 8 years old who don't have the ability to understand advertising.

"Little kids don't know the difference between a program and a commercial," says CSPI's Executive Director Michael Jacobson. The Institute of Medicine and the Supreme Court have said as much.

But the real concern for the group, and for parents, CSPI says, is that McDonald's advertising makes kids beg their parents to buy food that's high in calories, sugar, fat and salt, which contributes to obesity.

"Marketing to kids is an end-run around parental control," says Stephen Gardner, CSPI's director of litigation.

But CSPI is not asking for damages, just for McDonald's to stop advertising toys.

"This is about the change, not the money," Gardner says.

For its part, McDonald's has added healthier items to its menu in recent years, like apple slices, low-fat milk. But french fries still go into Happy Meals more than 90 percent of the time, Jacobson notes.

McDonald's and other fast food companies spend over half a billion dollars a year on advertising and marketing kids meals most of it on toys.

Separately, the San Francisco Board of Supervisors overrode a mayoral veto last month to push ahead with an ordinance that would effectively ban toys from most Happy Meals starting in December 2011.

UPDATE: 12:48pm. McDonald's spokesperson Bridget Coffing issued the following statement. It addresses neither toys nor advertising:

We are proud of our Happy Meals and intend to vigorously defend our brand, our reputation and our food.

We stand on our 30 year track record of providing a fun experience for kids and families at McDonalds.

We listen to our customers, and parents consistently tell us they approve of our Happy Meals. We are confident that parents understand and appreciate that Happy Meals are a fun treat, with quality, right-sized food choices for their children that can fit into a balanced diet

I can see both sides of the coin with this -
#1 to allow freedoms
and
#2 to not allow certain things because opportunity could lead to a certain behavior

case in point -
1. I never liked the lack of gun control in the states; and since living in england for the past 4 years I can see it even more so clearly. Opportunity could lead to problems.

Example; was a school shooting recently in the states and many people think about what the parents or teachers or peer groups could of done. But IMO the most obvious question is; what about gun control ... if the opportunity wasnt there for that child to get a gun and bring it to school then there would be no shooting.

2. Lets look at it on the opposite side of the coin. I used to think that the states had a big drinking culture and wisconsin being one of the biggest ... I WAS WRONG. I came to england ... I often see kids 18 and younger often 16 or even younger drinking on public transport or on street corners. Adults hanging in pubs much more here then in the states ...
IMO instead of trying to instill values and hoping people listen and make sense; IMO there needs to be better control. Higher drinking age and actual cops that dont allow antisocial drinking to occure ...

my point is that I think some rules and laws are good; I dont think we should be left to our own devices about anything that goes ...
yaya the freedom thing ... but seriously ... if someday your kid got shot with a gun in school - I know I would wonder if that would of happened if there were better gun laws and they werent just everywhere ...

You're right. If someday my kid gets run over by a car, I'm going to wonder why there isn't more car control. If someday he chokes on a piece of candy, I'm going to wonder why there isn't more candy control. If someday he falls off a slide and gets hurt, I'm going to wonder why there isn't more slide control. (Come to think of it, the problem these days is too much slide control. When I was a kid, we had slippery metal slides and we went down so fast that we flew off the ends. It was awesome. Nowadays, I watch kids literally pulling themselves down slides because the coefficient of friction on the plastic slides is so absurdly high. They're taking all the fun out of something as fundamental to childhood as a slide. But I digress.)

Seriously, Dulak, you can't prevent everything. With freedom comes an element of danger. That's the way it's supposed to be. That's what makes life fun. That's what makes life worth living. I'd far rather have the danger that comes with being able to control my own life than the illusion of safety that comes with the government telling me what to do. It's not like more laws really prevent problems anyway; they just drive the problems underground.

For example, the age of consent in Germany is 14, and in Germany, about 40% of babies are born out of wedlock. In America, the age of consent ranges from 16 to 18. Guess how many babies are born out of wedlock here? You're right -- about 40%. But at least in Germany, the teens mothers and their boyfriends aren't worried about going to jail for doing what humans do. The increase in out-of-wedlock births in this country is much more a function of young people being encouraged to delay marriage than it is teens having more sex than they used to. But I digress again.

Who gives a shit if teens are drinking anyway? Let them drink. It's not like they have anything else to do in our society that is so contemptuous of young people. Is fining and throwing them in jail for having fun really a better alternative? I'll bet you any amount of money the rate of teen death due to drunk driving is far lower in England than it is in the United States. I saw teens drinking all over the place in Germany, yet I never saw any of the public intoxication problems (fighting, binge drinking, etc.) that I see all the time in my home town, where the police patrol constantly and harass students at every opportunity.

The problems you decry are much more a symptom of a sick culture than they are of availability. If someone wants to get their hands on alcohol, they'll always manage to do so, no matter how tight enforcement may be. Similarly, if someone wants to commit a murder badly enough, they can always find a gun, no matter how strict the laws are. Or they can just use a candle stick.

I always said, we should take away ALL cars, cause some idiots abuse their rights and drive drunk. Makes as much sense as outlawing guns, because some idiots abuse them.
Fact is, when guns are outlawed in any place, the only people that have guns are the ones you should be most worried about. The criminals. They don't obey ANY laws, including "gun control" laws.
I bet alot more kids are killed because they got drunk or high then are killed by guns in schools. But school shootings get all the "headlines".
Guess we should take all booze and beer out of homes too, cause some teen might get ahold of it.
Now....with the thread, parents need to say NO and mean it. If the kid KNOWS he/she will get their way if they just whine long enough, who's fault is that? Bad parenting is the problem.
A swat on the ass is what those kids need. "OH!!! I CAN'T BELIEVE YOU SAID THAT!!! SPANK A KID?!?! YOU NEANDERTHAL!!!"
I'll tell you what....it worked on me when i was a kid. And i was NOT abused. Fact is, i deserved more spankings then i got. But the fear of consequences for my actions more often then not kept me in line. Not a bad thing, if you ask me.
