Jolly case dismissed; prosecutors expect to refile
Per my colleague Andy Nelesen, prosecutors in Houston have dropped a drug possession charge against Packers lineman Johnny Jolly. However, they expect to refile within 90 days.

Jolly was scheduled to go on trial Friday.

Charges are dropped but they're going to refile them? Well, at least he'll probably be able to start the regular season with no issues.

My guess, is they will be refiled with a different angle.. apparently the prosecution has some holes in their case, as they have been the ones to delay this a couple of times.

Interesting..

Still wish this kid would mature a little and drop the whole holier than thou attitude... either that or someplace in camp someone knocks it out of him.

Or the NFL steps on his playing time for a couple of games.. something to wake the young man up.

It looks like we'll have him the whole 09 season. Just enough time to find a replacement for him. The legal system in this country is laughable.

Ok out of curiosity what kind of suspension do you think he would deserve? I'm saying atleast 8 games after all it is a felony charge and people taking diet pills are getting 4 games.
Just Imagine this for the next 6-9 years. What a ride it will be 🙂 (PS, Zero should charge for this)

Andy Nelesen, of the Green Bay Press-Gazette, reports the felony drug possession charge against Green Bay Packers DL Johnny Jolly has been dismissed, but prosecutors are expected to refile the charge in the near future. The dismissal hinges on Houston Police Department's crime lab receipt of new equipment that can measure the amount of codeine in a substance, according to Harris County District Attorney's Office spokeswoman Donna Hawkins.
Just Imagine this for the next 6-9 years. What a ride it will be 🙂 (PS, Zero should charge for this)

A bit more, as dhazer posted above.

I wouldn't be surprised if this delay lets jolly play through the season, with how slow the court system has been talking it up to this point.

Also i think it coroberates the idea that the 200MG or whatever amount that he was busted with was the amount of liquid cough syrup or whatever, not actually the amount of illegal substance he was busted with, in all likelyhood it could equate to a pretty harmless amount if that is the case.

However, the legal substance in question was found in the system of the players in question. No one has accused Jolly of suckin' the sizzurp. He was never caught with any codeine in his system. He is not under the auspices of the drug policy. He is under the personal conduct policy. They are administered differently.

There was also a specific clause in both Williams' wall contracts that specificially precluded them from taking those or any pills to lose weight. They admitted they did precisely that in an affadavit filed in both state and Federal court. This aspect is semi-irrelevant, I'm just pointing out that they both made their contracts arguably voidable, but that would require the Vikings to actually care about character in their players, so forget that aspect.

The suspension they have been handed is the minimum for the offense they were found to have committed. There is no minimum penalty in the CBA for a violation of the personal conduct policy.

This one seems to be getting no notice. It is the first that we have heard some more detail...see above post and the difference between the personal conduct policy and the drug policy. It states here that he tested positive for marijuana. (The "ugly" part). Now the question becomes if a positive test in the legal system would subject him to sanctions by the league under the drug policy. I think he has to be caught by the league, not the police, but could easily be wrong on that one.

The good:

Overstreet said the prosecution had a copy of an affidavit by one of the passengers in Jolly's car stating that he was the one who possessed the bottle of Dr Pepper authorities say contained codeine.



The bad:

Assistant District Attorney Angela Smith, who had been the lead prosecutor in the case, said Jolly's defense team initiated the affidavit. But she said prosecutors weighed several factors in considering such affidavits, including the witness' credibility and criminal history.



And the ugly:

Also on file in the case are the results from a urinalysis screening conducted by Harris County authorities on the night of Jolly's arrest. The results indicate he tested positive for marijuana but negative for amphetamines, cocaine, opiates (such as codeine or morphine) and phencyclidine (PCP).

I'd think that "the ugly" is the best piece of evidence showing that Jolly is at worst negligent. He's still an idiot though.

Hopefully that positive test for marijuana is just from second hand smoke. Still, that's just as bad as smoking it yourself. Shouldn't be hangin' with people like that anyway.

Why is it that the whole marijuana thing is just now being brought up? Before now I never heard anything about it.

There is no such thing as a positive drug test from second-hand smoke. The minimum detection levels (MDLs) required to trigger positive results are so high that they preclude such false positives.

If he has been within making-out distance of pot smokers for 16 hours a day and deliberately inhaling vast quantities of smoke, he deserves any hammer the authorities want to lay on him.

The idea is preposterous.

What's the charges for MJ in the States?

Here in Quebec, Canada if you get caught on it they usually take you in over night, let you out the next day. Hook you up on some community work and sometimes you don't even get that. You don't receive any record either. Sometimes if your acting normal and causing no problem at all they will ignore it (that's most of the time).

Also if you actually carrying anything under 1.5g on you, your actually eligible to carry it unless cop wants to be an ass and just confiscate that, we all know why he does that ...

If he tested positive for weed.. so be it, I hope the NFL drops a couple of games of suspension on him for a combination of bad choices and violation of the drug policy.

As to if it can be Johnny Law that catches a player and they have to sit because of drugs, think back to Matt Jones to get your answer. Yes it applies.

Matt Jones, Jacksonville Jaguars wide receiver lost his appeal related to the suspension handed down by the NFL for violating its drug policy. He did not test positive for banned substances, rather he was set down for being arrested on a drug charge. That happened in July when he was taken into custody by police after being found in his automobile with cocaine and marijuana.



Simply put, I hope he doesn't get a free pass and have no accountability for his actions. The guy has the potential to be a very solid player in this game.. he just might need a kick in the ass to reach it.
