If you start snooping on people's social network profiles, how are you going to ensure you don't get sued for age, marital status, sexual orientation, religious, or other forms of discrimination?

I don't think you can, outside of citing a legitimate source/reason why one doesn't get the job or gets fired in some cases.

The same way as when anybody gets fired for any other reason.

If you fire someone for any of those reasons, you probably get what you are asking for to get sued.

But anybody can file a lawsuit, true or not.

People who suck at their jobs don't like to admit it sometimes. It is easier for their ego's to blame whatever else they can think of rather than the fact they are a crappy employee who can't get their work done.

So if you fire someone, you have to document why. If you have a discipline problem, it has to be in their file. If you have an absentee problem, that has to be documented. If you have too many customer complaints, record it.

If it isn't documented, you don't have proof that you had a real reason to fire someone. Then they can accuse you of some kind of discrimination.

Like everything else in business, don't leave anything to chance.

I wasn't talking about after they are employed. By that time, most people know how old they are (more or less), whether they're married, etc. I am talking about during the hiring process. Most HR departments are almost fanatically careful that protected information doesn't come out that might give someone grounds for a discrimination charge. If you are viewing applicants' profiles, you are privy to all sorts of information that is normally not considered during hiring. In this case, you aren't going to have a job performance or discipline file to fall back on if you get hauled into court.

Why do companies want to only hire employees with unquestionable ethics, when many of the companies operate without any?

Asking me to give up my personal passwords and reveal my personal life is ethically questionable to me, because it's simply invasive, and offers no greater good.

And here is the real kicker folks..In an interview...without paying me, if they're already going to work me into a corner, what will happen once I work there?

You need to vet the companies/owners as thoroughly as they vet you.
Would you really want to work for a company or owner that is pretty much a version George Orwell's "Big Brother"
Trust me, any company or owner that wants to exert that much control over your life is not worth working for....you will regret it.

Be careful out there, many HR people are sneaky bastards...

But yes, I would recommend that anytime you tie yourself to any group, employment or otherwise, check them out thoroughly. You never know when someone else's past can come and bite you in the ass. That is really all those companies are trying to do.

Just because it can be accessed illicitly does not mean that people should have the right to demand access to it.

People can demand the access to anything they damn well please as long as they're not threatening, blackmailing, harassing, or otherwise violating completely independent laws. Doesn't mean they're going to get it though.

Agree with that one a lot more, it's kind of borderline with me with employment but the second it turns into "give me THIS or I will do [negative]" rather than "give me THIS or I won't give you [positive]" is where it crosses the line for me.
