Well to be honest.. this all seems a little convenient. Looks like he dodged a bullet on charges.. but seems like the DA isn't pushing it real hard either.

Whom says there is no favoritism in the justice system.. heck in all forms of government.

The Nevada County (Calif.) district attorney's office has returned the drunken driving case against Green Bay Packers tight end Spencer Havner to the California Highway Patrol after finding insufficient evidence to charge him, district attorney Clifford Newell said Tuesday.

Havner was arrested on suspicion of drunken driving March 13 at a hospital emergency room after allegedly crashing his motorcycle. Newell said in an email that after reviewing the case he "could not determine that Havner had committed a violation of the California Vehicle Code or any other law."

He said he sent the case back for further investigation with directions to provide more detail and witness testimony.

Newell said Havner was in the emergency room receiving treatment when police first spoke to him and that officials only know Havner may have been near a crashed motorcycle before being taken to the hospital. The vehicle had been moved from the scene before the highway patrol arrived, and Havner has little or no recollection of the event.

Havner suffered a broken shoulder and other injuries and did not report to off-season conditioning until last week. His work has been limited and the recovery time was predicted to be four to six weeks from the time of the incident

Gee, that doesn't sound suspicious. I hope the Packers still punish him, significantly. As much as I want him on the field winning us games, this CAN'T happen again.

What the FUCK, people? If there is insufficient evidence, that means his BAC test came in below the legal limit! Why are you PRESUMING miscarriage of justice in an otherwise straightforward case? Just because he smelled of alcohol or was loopy doesn't mean he was legally intoxicated. So the DA does the right thing by letting him go.

The constant conviction of people in the court of public opinion pisses me off. I really hope none of you are ever on the raw end of it.

If you read into the original posts, they determined at the hospital that he was legally drunk.. IE blood test. And now they are claiming nothing about his BAC.. they are talking about not being able to prove he was driving the cycle being to it being moved.. probably to assist Spencer with his injuries.

My main objection here is that to insinuate obstruction of justice, as multiple people in this thread have done, is a HUGE leap to make, borders on libelous, and is conceivably actionable.

I stand by my other point: We may bitch about people getting off too easily, but if any of you are ever on the block, you will be praying your heart out that you are accorded the same caution before the law. So instead of begrudging the mistakes that are made, be happy that such precautions are built into our legal system. Better that 10 guilty men go free than one innocent man be wrongly punished.

* CHP got the call from the hospital -- it is called in all injury accidents -- and Havner was contacted at the hospital, where he was tested for driving under the influence. He was subsequently arrested for DUI.
* Havner was then released to the care of Sierra Nevada Memorial Hospital in Grass Valley.
* Blood-alcohol level is not releasable at this time. The legal limit of blood alcohol level is .08% in California.



Of course they couldn't release his exact BAC or that he was admitted for treatment.. the is part of the normal process as a person is allowed due process.

BTW... it appears convenient.. if they are balking at the charges is because he was taken to the hospital by a private party and CHP didn't see him on the cycle.

It isn't some whopping miscarriage of justice.... just convenient that there is some holes to it.
