No nerve. I usually love this kind of stuff. Just tired at moment from arguing about the arrested nurse in Utah in another venue. I very very rarely wade into those kind of issues. No amount of examples or logic is going to change some people's minds. More of a give up than anything. White flag on this issue for now.

Plus, if N Korea decides to end us, I don't want to go out arguing this. Other things are fine 🙂

I found reading about implied consent interesting. It make sense why the officer thought he was in the right to just take blood without verbal consent (and almost was). Though not the right place to talk about this... this article helped me understand what was happening.

But while Utah’s law is constitutional, it turns out not to have permitted this specific blood draw. As written, Utah’s law only permits an officer to conduct such a test where he has reasonable grounds to believe that a person from whom blood is to be taken was driving “while in violation of” the laws regarding driving under the influence of alcohol or other substances. In this case, the detective specifically lacked any such grounds, because the draw was being taken to show the opposite – that the driver was not under the influence. Utah’s implied consent law did not authorize this particular blood draw under these particular circumstances.

I posted that article so everyone could understand. I was wrong on implied consent to the degree request was made for wrong reason. Had officer sought it for DUI suspicion legally speaking she was wrong he was right and she needed to be arrested for not complying. I understand there was a supposed agreement between hospital and PD but I refer to the law. A very complicated issue. A judge may have ruled differently than the law professor indicated.

Btw, As I suspected when I tried PMing my old teacher he compared her arrest to Nazi Germany and lied, in my opinion, saying he would've NEVER arrested her. A true clueless MMQB.

PS. Did u like when the attorney called me a douche? Hilarious.

I read the article the other night and thought it was helpful in understanding.

Even if she was wrong, I very much disagree with "she needed to be arrested for not complying". Because there is no need, it's simply the dick move, that doesn't help him in anyway. Simply find what room the guy is in, say you want to check on the guy, and walk past her and get what you need. If she then tries to stop you, you then arrest her... but not for professionally talking to you.

Dick moves are never good (even if they're legal), locally we had a record snowfall a couple years back, with nowhere to easily move the new snow... and police of course where saying don't put the snow in the road. A police officers sees someone doing it, and arrest the man. Turns out the man was almost 90 years old, who shouldn't of been trying to clean his driveway by himself, but he was trying to clear his driveway for his wife could get to her doctors appointment. The police officer had every legal right to arrest the man... but it was still a dick move, that came back to bite the officer in the ass... as he ended up being the one in trouble.

Just because you have full power and control doesn't mean you should be a dick about it.

Haha!

I wasn't pro arresting her. Only that he felt he had legal backing to do so. Tough issue. To show no Dui, time is important. The nurse impeded his ability to do his job. I understand why he did it but thought he was a jerk about it. I also understood why she did what she did.

Another key is his Lt. told him to. If u feel you have legal right and your superior is telling you to arrest what are you gonna do?
