NFL Asks Supreme Court to Reconsider Class Action Over Sunday Ticket TV
BY MATTHEW VADUM March 5, 2020 Updated: March 5, 2020

The Supreme Court may soon rule on whether an appeals court decision that revived a class-action lawsuit claiming that DirecTV’s NFL Sunday Ticket, which bundles all NFL games into a package available exclusively to subscribers of the company’s satellite television service, runs afoul of federal antitrust laws.

The court could decide as soon as March 6 if it will hear the appeal, cited as National Football League v. Ninth Inning Inc. The NFL, an unincorporated association of 32 member clubs, and DirecTV, were sued by plaintiffs Ninth Inning Inc., 1465 Third Avenue Restaurant Corp., Robert Gary Lippincott Jr., and Michael Holinko.

The NFL and DirecTV are urging the Supreme Court to consider their appeal.

Attorneys for both organizations argue that the 9th U.S. Circuit Court of Appeals made a legal mistake when on Aug. 13, 2019, it ordered a class-action suit reopened that claims the Sunday Ticket package forces football fans to “pay more for games than they want,” contrary to a federal law known as the Sherman Act.

The law forbids competing businesses from working together to raise prices and limit consumer choice. The appeals court undid a lower court’s dismissal of an action brought in 2015 by a group of fans, bars, and restaurants who purchased the Sunday Ticket package.

According to court documents, each of the NFL teams signed an agreement with the NFL to pool their telecasting rights and provide the NFL the authority to exercise those rights. Acting on behalf of the teams, the NFL made two additional agreements licensing the teams’ telecast rights with CBS and Fox. The two television networks are permitted to broadcast a limited number of games through free, over-the-air television.

The agreement between the NFL and the two networks allows DirecTV to package those telecasts as bundled feeds to Sunday Ticket subscribers. The plaintiffs say these agreements function to limit competition for the sale of professional football game telecasts.

Watching football on the small screen on Sundays can get expensive.

“If Baltimore Ravens fans living in Miami want to see a live telecast of their team’s game on any given Sunday, the only option is to buy an entire season of DirecTV’s NFL Sunday Ticket for $293. The same is true for Eagles fans in Los Angeles, Patriots fans in Chicago, or any NFL fan rooting for a faraway team,” ESPN reports.

In the opinion written by Judge Sandra S. Ikuta last year, the circuit court seemed to express sympathy for TV viewers as it found there may be an antitrust law violation.

“Every Sunday during football season, millions of National Football League (NFL) fans tune in to watch their team play. If they live in the same area as their favorite team—such as Los Angeles Rams fans who live in Los Angeles—they can tune into their local Fox or CBS station to enjoy their team’s game on free, over-the-air television. But if NFL fans happen to live far away from their favorite team—such as Seattle Seahawks fans residing in Los Angeles—they can watch every Seahawks game only if they purchase DirecTV’s NFL Sunday Ticket, a bundled package of all NFL games available exclusively to subscribers of DirecTV’s satellite television service.”

The plaintiffs, Ikuta noted, claim that if this restrictive arrangement didn’t exist, “the individual teams would create multiple telecasts of each game and would compete against one another by distributing telecasts of their games through various cable, satellite, and internet channels.”

An NFL loss in the litigation would help consumers, one expert told ESPN.

“If the NFL were to lose, I don’t think it is necessarily so dramatic in terms of the way you will watch NFL on satellite or cable,” Stefan Szymanski, a sports economist at the University of Michigan, was quoted as saying. “But it should be good news for consumers because they should be paying less” for games outside their market.

Mucky Tundra (15h) : rough injury for tank dell. guy can't catch abreak
beast (17h) : So far the college playoffs have sucked... One team absolutely dominates the other
beast (19h) : Well even if you weren't positive towards a guy, you wouldn't nessarily want to tell the media that (if they don't know about it)
Martha Careful (20h) : I think MLF want Love to look past the end half issues, and feel good about his play. Our coaches generally keep a very positive tone.
beast (20h) : I think a great running game will do that for most QBs
packerfanoutwest (20h) : Coach Matt LaFleur has said quarterback Jordan Love is playing the best football of his career.
beast (21-Dec) : Oh, that's how you keep beating buckeye, with cheating
Zero2Cool (20-Dec) : There is a rule that if your name starts with 'b' you lose 15 points. Hey, I don't make the rules, I just enforce them!
wpr (20-Dec) : and then there is Beast. Running away with it all.
beast (20-Dec) : As of tonight, 3 way tie for 2nd in Pick'em, that battle is interesting!
beast (20-Dec) : Lions vs Vikings could be the main last game as it could determine division winners or #1 vs #2 seed
Mucky Tundra (20-Dec) : Or if KC needs to win for the #1 seed
Mucky Tundra (20-Dec) : Right now it looks like the only prime worthy games are Det-Minny and KC-Denver (if Denver can clinch a wild card spot)
Mucky Tundra (20-Dec) : The entirety of week 18 being listed as flex is weird
Zero2Cool (19-Dec) : Matt LaFleur today says unequivocally "Ted Thompson had nothing to do with the drafting of Jordan Love."
Zero2Cool (19-Dec) : Apparently, the editing is what pieces comments together. That Ted thing ... fake news.
Zero2Cool (19-Dec) : LaFleur "opportunity that Ted Thompson thought was too good to pass up"
Zero2Cool (19-Dec) : Jordan Love pick was Ted Thompson's idea.
Mucky Tundra (19-Dec) : Kyle Shanahan on signing De'Vondre Campbell as a FA last offseason: “We obviously made a mistake.”
packerfanoutwest (19-Dec) : Alexander’s last season with GB
Martha Careful (18-Dec) : if I were a professional athlete, I would probably look to see who the agent is for Kirk Cousins and then use him

Mucky Tundra (18-Dec) : a lower case b
Mucky Tundra (18-Dec) : The real lie is how beast capitalized his name in his message while it's normally spelled with
packerfanoutwest (18-Dec) : haha that's a lie
beast (17-Dec) : Despite what lies other might tell, Beast didn't hate the Winter Warnings, it felt refreshing to Beast for some reason.
Zero2Cool (17-Dec) : whiteout uniforms in general are pretty lame and weak. NFL greed at it's worst
Martha Careful (17-Dec) : The Viking uniforms, the whiteout uniforms specifically absolutely suck
beast (17-Dec) : Thanks Zero2Cool, looks a lot better now
beast (17-Dec) : Seems like someone has a crush on me, can't stop talking about me
Zero2Cool (17-Dec) : Should be gooder now. The forum default theme went to goofy land.
Zero2Cool (17-Dec) : What the hell
packerfanoutwest (17-Dec) : yeah beast hates the Winter Warning Unies
Mucky Tundra (16-Dec) : Okay I'm glad to know it's not just something happening to me lol
Mucky Tundra (16-Dec) : Zero, did you copy the Packers uniforms from last night and white out the board?
beast (16-Dec) : Oh crap, is the board going to the Winter Warning Uniforms too?!? It's all white on white right now!
Zero2Cool (16-Dec) : WR Odell Beckham Jr is officially a free agent after clearing waivers.
Zero2Cool (16-Dec) : Packers are 6th in sacks.
Zero2Cool (16-Dec) : RB David Montgomery will undergo season-ending knee surgery.
Mucky Tundra (16-Dec) : Dan Campbell on onside kick with 12 minutes left: In hindsight, wish I didn’t do that

Zero2Cool (16-Dec) : That was crazy to hear go pack go in Seattle of all plays. That 12 man thing an all
Mucky Tundra (16-Dec) : jdlax, good man!
jdlax (16-Dec) : Mucky, there were too many of us there to credit any single one but for sure i was 60% responsible.
