Dance turned into a federal offense

Look, no one wants people dancing at national monuments.

Folks doing the electric slide at the Vietnam Veterans Memorial would ruin the spirit of reverence and reflection it inspires. Still, it is hard to believe we need a federal law, a court ruling or squadrons of police in order to enforce that restriction. Sadly, we have all three.

It seems that one night in April 2008, a woman named Mary Brooke Oberwetter and some friends went to the Thomas Jefferson Memorial in Washington to celebrate the third president’s 265th birthday with a silent, interpretative dance. For this, they were arrested by U.S. Park Police.

Oberwetter sued. Last month, a federal court dismissed the case, ruling the government is not required to allow “the full range of free expression” in a space built for “a solemn commemorative purpose.” A few days back, protesters took to the Memorial to silently dance their dissent.

The result is captured in videos that have gone viral. We see police pull apart a couple who are quietly swaying together. One guy who fails to respond to police orders is body slammed and appears to be choked by an officer. Another, who does comply, is nevertheless thrown to the floor by an officer and what appears to be a civilian because he moved his arms semi-rhythmically.

All of this unfolds in the shadow of Jefferson beneath this inscription: “I have sworn upon the altar of God eternal hostility against every form of tyranny over the mind of man.”

And here, let us interrupt our regularly scheduled column for the following commercial announcement: “The disease of irony impairment continues to afflict an estimated one out of every three Americans. But doctors are hopeful that with your help, a cure can be found. Our lines are open, operators are standing by. Please give generously.”

Ahem.

Without debating the fine points of the court’s ruling, it is useful to ponder an alternate reality in which the protesters are simply ignored. They wiggle around, they go home.

Does an anarchic epidemic of dancing at national monuments then ensue? No. This would be unlikely for the same reason you don’t ordinarily see in public swastika T-shirts or other items that are objectionable, but arguably constitutional.

We are social creatures and, as such, typically conform to the mores and norms of our society. The threat of other people’s disapproval is usually enough to make us behave. It is not a perfect system, but it works way more often than not.

So what’s most offensive about these arrests for crimes of Terpsichore is not the insult to free expression, but the insult to common sense, the implied assumption that unless some guy waving his arms around is thrown to the ground and handcuffed, the rest of us will indulge our secret desire to do the Macarena in the temple of Lincoln.

There is something heavy-handed and totalitarian in that assumption.

Give folks a little credit. People visiting solemn public places usually require little more than a placard or two to keep them in line — certainly not the weight of federal law or a police boot.

We hear so much blather lately about the ability of the free market to regulate itself. Too bad some of us have so little respect for the ability of free people to do the same.

You actually don't have any rights to do whatever you want wherever you want anytime you want. But there are morons who are always willing to waste everybody's time trying to make a federal case out of nothing.

Sigh.

Funny, I don't remember a "solemn commemorative purpose" exception to the rights of free speech and association.

Oh yes, and if solemn commemorative purposes are so fucking important that they trump the first amendment, how come we allow all the carnival shit and tourists in bad shorts everywhere on the Mall in DC? Or how come we allow your average Congressional pinhead to ever open their mouths?

I remember when I visited the Jefferson Memorial. I have no idea how popular it is today. But 20+ years ago, when all the usual suspects on the mall were full of tourists, it was just about deserted. Part of this was because it was a bit of work to get to. (Since its easy to spend your whole day just on the "attractions" of the Mall, why walk all the way around the tidal basin.

To my mind, there are two places everyone who goes to Washington should go. One is the Wall. The other is the Jefferson Memorial.

This kind of court ruling should appall everyone.

That it doesn't shows just how fucked up we have become as a country.

By the way, I showed this story to some of my German classmates, and they were frankly appalled. If the Americans still wonder why the United States has become a laughingstock in the eyes of the world, we should really take a close, hard look at ourselves.

In my opinion the whole freedom of speech, etc gives off the perception of one being able to do as they please, however for a free country I feel we are pretty damn uptight on some menial activities.

I am by no means advocating that people should be able to do whatever they want, whenever they want. That's not libertarianism, that is libertinism.

But dancing in public?

C'mon, man!

As someone who studied Jefferson, I'm pretty sure Jefferson would want people to dance at his memorial. Although pre-Romantic, he did have some Romantic ideals (not the stupid modern definition of Romanticism, but the original definition like Lord Byron, the Shelleys, and Beethoven).

And yes, Freedom of Speech does say to do as you please. The ONLY exceptions that I'm aware of when it comes to Free Speech are copyright violations, slander, and verbals threats of violence. Even in the last case, it's pretty specific. You can say "all Buffalo Bills fans should be rounded up and murdered" but you can't say "Jim, I'm going to kill you because you are a Buffalo Bills fan." Jim now has the right to shoot you dead in self-defense.

(Sorry Bills fans for using you as an example, but I had to use someone and I didn't feel like using a race/class/gender/sexual orientation this time for my example).

By the way, the cops in this video deserve a good kick in the nuts.

And lastly, if you don't dance at my funeral, don't bother showing up. Seriously. There will be booze, boobs, illegal drugs, and there will be dancing. That's an order.

Heh. Unless I get hit by a car, I'm outliving VR. He's got like 40 years on me. Formo will probably jump off a bridge within 10 years (due to his MIL, not by being a Vikings fan). I plan to be around a long time.
