From my observations of the criminal justice system, they don't want people to go to jail. It is expensive and it really doesn't do much good. A 60% recidivism rate would illustrate that fairly well. What they are trying to do is get people to stop committing crimes.

If the offender is a career criminal and shows no interest is rehabilitating himself, the only recourse is remove them from society as much as possible. But for people that have a productive job and may have a chance to change their behavior, if they show an honest interest, they tend to try as many things as possible to keep them out of jail. Rehab, probation, suspended sentences, etc. Regardless if they have money or a good lawyer.

One of the keys I noticed was people have to be responsible for their own behavior. I see a lot of people going before a judge saying, "it wasn't my fault" when they were in a bar punching a girl while on probation or something.
I want to go out like my Grandpa did. Peacefully in his sleep.

While most of this is true, it can't be denied that Jolly's attorney was one of the major reasons he got such a generous plea deal. For example, I bet I wouldn't get the same deal myself, and I do have quite a bit of personal experience within the court system. I've seen it happen many times. Attorney's basically ask "favors" of the DA (generally his buddy) before going before the judge, and then they basically just say what has been worked out previously before the judge. Generally a pretty quick process for drug related issues.

I don't know how to go about finding out what the normal sentence would be for something like this. I did find this, where the late Chargers' Terrence Kiel got busted for felony distribution of codeine. This guy was caught actually distributing it, not just having a bottle of it in his car-

In September 2006, Kiel was arrested for multiple drug charges including possession, possession with the intent to sell, and transportation of a controlled substance. Police came to the Chargers practice facility and arrested him. He was released after posting a $1,550,000 bond.

In February 2007, he pleaded guilty to felony and misdemeanor drug charges for shipping codeine-based cough syrup to Texas. He was released by the Chargers after his plea and was sentenced to three years of probation. The felony charge was dropped after he volunteered for 175 hours and underwent counseling for gambling.

Think of it this way:

Right now a bit over 3 percent of the USA population is in jail or prison, or something over 9 million people. The average cost of supporting an inmate is about $30,000/year. Or about $270 billion/year.

And that doesn't count the lost income/productivity from (some) of those imprisoned.

Now think about how those numbers might change if prosecutors didn't bargain things down with the frequency they do.

Do we really want to build more prisons just so we can lock up the Johnny [strike]Idiots[/strike] Jollys of the country?

Out of jail, Johnny Jolly is at least semi-productive (else teams like the Packers wouldnt have paid him what they did/would). Inside jail, he's just another drain on tax resources.

Perhaps it would be better to let the rich bastards regularly buy their way out of jail time Change the law so that plea bargaining could require mega-fines instead of nonsense "public service hours". Make it really hit their pocketbook.

I thought it was a pretty light number myself.

Jails cost a lot to build, they are not made of stick lumber and drywall. Jailers cost a lot to hire, there are probably a couple staff members per prisoner between guards, administrative personnel and maintenance for 3 shifts a day. Food, medical, electricity, gas, sewer and water, phone, data etc. It all adds up.
