Anybody have the name or pictures of this ride? What the hell kind of ride is it? They made it sound like they just drop you into a net, and the net wasn't up.

Thats pretty much it. They drop you from a 100 foot distance. The operator is SUPPOSED to make sure the net has been brought up before a person drops. The guy didn't do so, and the girl hit the ground.
Had the net been up and she still got hurt, i wouldn't hold the guy or the owner of said ride responsible. But it was negligence.
Safety equiptment can only work if the person responsible makes sure it's up.

This girl is going to have a lifetime of physical problems. And it was the fault of the operator that she got hurt.
Should the guy go to jail for it? I don't think so. But he AND the owner of the ride share a responsibility to pay for the girl's care and whatever other bills the family gets because of this.

Oh, I don't dispute the question of financial responsibility if the guy was negligent or worse.

I only object to the notion of doing this through the prosecutor's office.

Police: Wis. ride worker hit self after girl fell

LAKE DELTON, Wis. An amusement park ride operator hit himself in the head with his fists once he realized a young girl had fallen about 100 feet from the ride without a safety net, according to police reports released Monday.

Teagan Marti, 12, of Parkland, Fla., fell from the Terminal Velocity ride just outside Wisconsin Dells on July 30. She survived, but doctors have said she could be paralyzed.

The ride's divemaster, Chuck Carnell, 33, has been charged with one count of first-degree-reckless injury, a felony punishable by up 25 years in prison and $100,000 in fines.

Carnell told investigators that he "blanked out" and never saw the "all-clear" signal before releasing Teagan, according to the criminal complaint.

According to reports released Monday, other riders told police that when Carnell realized the child had fallen, he hit himself in the head, then got on his radio and said he had just killed her and should go to jail. He also asked to have his pastor come to the amusement park.
Carnell's attorney didn't immediately return a message for comment.



This is why you keep your mouth shut, no matter how guilt-stricken you may feel. Admitting guilt before you even get to trial isn't going to help your case much.

Well.....i myself would be more leinient on a guy that showed he was sorry for his mistake. If i was on the jury, i'd be more likely to lower any punishment to him because of it.
But that's just me.

Yes, but he's admitting guilt before he's even been found guilty. Just because you're charged with an offense doesn't mean you're actually guilty of it. By taking this approach, he's all but guaranteeing he'll get punished, instead of allowing a jury of his peers to examine the issues and determine if he actually violated a law.

Cheesey does have a valid point here. It shows that the guy is not a sociopath and shows remorse immediately for his mistake.

A jury will be a lot more forgiving to a guy like this than to a guy who is stone cold.

But he's guaranteeing he will be found guilty of something. If he hadn't blabbed on himself before the authorities even arrived, he might have been acquitted outright. It's always a balancing act.

See, this is one of the reasons these sorts of things should not be crimes.

Our civil behavior toward each other should not be governed by what a criminal jury may or may not do.

Jail is for people who owe "society" something. Who have harmed society.

And remorse should not be the determining factor for civil liability. Remorse may be grounds for social forgiveness. And if the person injured wants to forgive him, that's up to that person. But if the person wants to sue him for everything he has, that's what she should do.

Criminal "Guilt" and civil "liability" are not synonyms. And, dammit, I wish people would stop treating them as such.

Negligence means the ride operator owes a shitload to the person harmed. He doesn't owe shit to society unless, somehow, what he did harmed society.

And if a cop tries to get a prosecutor to bring the weight of his office behind penalizing a civil wrong because of what a distraught man says about "guilt", then the prosecutor's job should be to tell the cop to fuck off.

And anyone who enables the prosecutor to do anything else should be told to fuck off as well.
