Wow. I didn't know you lived in Nevada City, Cheez. There's nothing out there, and I noticed recently that the population has been actually declining.

I hope he's ok. Even if he was drinking, I have A LOT more sympathy for people who drink and drive on motorcycles or bicycles (yes, for some stupid reason they give DUIs to people on bicycles). On those vehicles, you're just going to kill yourself instead of innocent bystanders.

I live in Citrus Heights, not Nevada City. I have been there taking my son to cross country meets (at Havner's old High School) and when friends and relatives visit take them to the gold country. Oh and I've gone with friends 4 wheeling and fishing out there.

Havner was not indicted today, so it will be at least a week. DUI arraignment are only made on Fridays in that county.

Whether or not a DUI charge would stick would be determined by what his BAC was at time of testing and method of testing. If by blood it will return a higher value. It can be determined if he was coming up or coming down.

The testing was done by blood at the hospital. In California the hospital is required to report the results to the Highway Patrol.

It is in the DA's hands now.

When it comes to DUI, "everyone makes mistakes" is a silly platitude. Driving while intoxicated is not a mistake -- it's a deliberate choice that takes time to make. Precisely because I believe so strongly in individual freedom -- and with it, responsibility -- I have no sympathy for anyone who commits this offense.

Of course, I am withholding judgment until further details emerge.

"Taking responsibility" is one thing. "Making people take responsibility" is another. Count me as one of those who thinks we've gone overboard in ensuring each other's safety by imposing legal (and sometimes criminal) penalties on bad choices.

Not every harm, no matter how "big", should be compensable under the law. Because not every harm, no matter how big, CAN be compensable under the law.

I agree, of course, but I believe that vehicular homicide while under the influence should be prosecutable as first-degree murder, because it is the consequence not of an instantaneous snap decision but of a string of decisions over time.

You're obviously less dangerous to other vehicles when you're in a motorcycle, but you certainly can still hit someone else, and drive them off the road. What's some old lady going to do when some idiot flies off his bike and onto her windshield, if not panic and swerve? What about pedestrians?

Havner signs tender, reports for off-season program

Tight end Spencer Havner, recovering from a broken bone in his shoulder suffered in a motorcycle accident March 13 in California, signed his exclusive rights free agent tender and began taking part in the Green Bay Packers' off-season conditioning program Tuesday.

The Packers were unable to examine Havner following the accident because he was told not to travel by airplane right away. After a little more than two weeks of healing, Havner was given the OK to return to Green Bay and meet with Packers officials. At the NFL owners meetings last week, Packers coach Mike McCarthy said he had spoken by telephone with Havner about the accident.

Havner was arrested by Nevada County police on suspicion of driving under the influence, but the district attorney's office has yet to file charges. General manager Ted Thompson said that Havner remains in the team's plans despite the incident.

A source with access to the NFL's transaction wire said that Havner signed his one-year exclusive rights tender on Tuesday. Havner's agent, Mark Humenik, confirmed that Havner had signed the deal and was in Green Bay for the off-season program.

Havner is limited in the work he can do because of the shoulder injury, Humenik said. But there is a good chance he'll be available for organized team activities in June.

"Without our doctors being able to lay their hands on him, I would just guess," McCarthy said last week regarding Havner's timetable for a return. "But based on my conversation with him, (he'll be sidelined) four to six weeks."

Neither McCarthy nor Thompson would say if Havner would face team sanctions.
