Football legend Michael Irvin accused of rape at Seminole Hard Rock 

[img_r]http://media.miamiherald.com/smedia/2010/02/04/20/MIRVIN.embedded.prod_affiliate.56.JPG[/img_r]A woman who says she was raped by football star Michael Irvin at the Seminole Hard Rock Hotel & Casino filed a civil lawsuit against him Thursday in Broward Circuit Court.

Although no criminal charges have been filed, the Broward State Attorney's Office has been looking into the case and is expected to reach a conclusion next week, said spokesman Ron Ishoy.

The woman said the attack happened in 2007, in the late hours of July 4 or early July 5. The suit doesn't name the woman, referring to her as Jane Doe.

Irvin's lawyer, Larry Friedman, called the accusations ``totally untrue.''

When asked to describe her contact with Irvin, Friedman said, ``Beyond, perhaps, meeting her, there was nothing.''

In the suit, the woman said Irvin bought her alcohol to get her drunk, then lured her to his hotel room. That's where he and another man tried stuffing money into her clothes, the suit said.

She said Irvin and the other man insisted on sexual favors. She said no.

That's when the unidentified man held her down and covered her mouth, according to the suit, then Irvin raped her, she said. When Irvin was done, the other man forced her to perform oral sex.

Afterward, Irvin's brother, Derrick Irvin, came in and took her to another room and ``assisted in covering the sexual assault and rape up,'' according to the civil lawsuit.

The one man is unidentified because the woman doesn't know who he is, said her lawyer, David Lister.

It was reported to Seminole police on July 20, 2007, Seminole Tribe spokesman Gary Bitner said.

``They investigated it thoroughly,'' Bitner said. ``Although by that time there was no longer any forensic evidence or surveillance video.''

A day later, the woman signed a waiver of prosecution, which Bitner attributed to ``her desire to essentially put it behind her and not have it be splashed all over the newspapers.''

Bitner said the tribe turned over its findings to Broward prosecutors.

The woman's lawyer, Lister, said he had no comment about the Seminole police investigation.

He said his client had passed a polygraph test.

Lister also said his client and Irvin's counsel had been in negotiations for a financial settlement, but those talks stalled, prompting the lawsuit filed three days before the Super Bowl is being played in Miami.

``There were discussion back and forth between the parties,'' Lister said, adding that Irvin's representatives had asked for a settlement figure. ``Nothing came of it.''

Friedman, Irvin's attorney, called the discussions attempts at extortion.

He said the woman came forward last year, after Irvin appeared on a few episodes of the television show Dancing With the Stars.

First, she wanted $1 million, Friedman said, then came down to $800,000.

Each time, Friedman said no.

``This complaint is tantamount to criminal extortion,'' Friedman said. ``There is no merit to the complaint.''

Irvin, an NFL Hall of Famer, grew up in Fort Lauderdale and was a star at the University of Miami before joining the Dallas Cowboys.

He's had run-ins with the law, including pleading no contest to a cocaine charge in 1996.

Later in that same year, Irvin and a teammate were accused with sexually assaulting a woman. An investigation revealed the woman had made up the story and she soon recanted.

It's floozies like this who piss me off, because they make life difficult for genuine victims of sexual assault. They don't have the balls to report the crime in a reasonable period of time (this woman waited 16 days? -- come on!), and so, since they don't have a prayer of winning in a criminal court, they decide to whore themselves out for a few lousy bucks in a civil case. A recent Time magazine article lamenting how low rape conviction rates are (implying that the deck is stacked against women in the legal system) revealed a couple of interesting nuggets: At least 25% of women who accuse men of rape admit to having consensual sex with the accuse AFTER the rape supposedly occurred, many for as long as a year afterward. And even in cases where there appears to be genuine distress, the alleged crime is frequently not reported for months or even years, eliminating any possibility of conviction in a criminal court.

In other words, it's the victims' own fault that conviction rates are so low. It is a truism that in a sexual assault case, it's the victim, not the accused, who's on trial, since there are so many false allegations. I read an article recently in which it was estimated by law enforcement officials who've worked in the field for years that at least 60% of sexual assault charges are entirely groundless.

I have no sympathy for this woman. If she was actually assaulted by two men, there was ample physical evidence, but she literally washed it (and her chances) down the drain. I would have considered myself lucky to have been assaulted by a "top" back in 2002, but I had the misfortune of being assaulted by a "bottom," so even if there had been any evidence, it would have looked consensual on my part. My case never had a chance -- so be it. But these supposed victims (male or female) . . . they infuriate me.

And then to try to exploit the situation by dragging the man's reputation through the mud for a few measly bucks . . . the only reason you take a case to civil court is that the standard of proof is lower, which in my opinion, calls into question the veracity of the entire claim. Not to mention, suing for money just seems so mercenary -- and disproves her statement that she just wants to put the whole thing behind her.

I hope there is a special section of hell reserved for pernicious, ambulance-chasing whores like these.

i didn't read your entire response, non but in skimming it, i agree with you. i will never understand people who do this. she has to know how this makes her look but doesn't care cuz she might get some $$ out of it. ridiculous!!

I think if someone is accused of rape, and acquitted, the accuser should do jail time.

I think the accusation is shady at best (as written here without facts)... but I wouldn't put it past Irvin do something of this nature.

It isn't like this guy is a choir boy and runs in the best circles.

I think if someone is accused of rape, and acquitted, the accuser should do jail time.

An accusation shouldn't automatically mean a criminal conviction. Just because an acquittal was obtained doesn't mean the rape didn't occur.

Rape allegations shouldn't be deterred because this sets a bad precedent for would-be rapists. At best, you could consider filing a motion for libel or slander, but with the nature of the courts, the only ones who win are the lawyers.

Well, let's agree that we fans probably don't know what guys like Irvin do, really.

That said, from everything I've seen, the guy has worked very hard to turn his life in a more positive direction than it had been headed when he was younger. I'm inclined to give him the benefit of the doubt - people can change, I believe.

He's an easy target due to his past, and that's his own fault. Still, this accusation smells bad to me.

Agreed, that I can't speak to Irvin's whole character off the field.. but I certain can use what he has done in his past to say that is wouldn't be a shocker if guilty.

Multiple drug arrests, assault reports, and a well known fact that he was a regular at the "White House" near the Cowboys training facility.. much like the one in Washington.. not much good or legal acts took place at the ""White House".

Again.. I don't understand the delay in the filing other than to dig some money out of his pockets.. but again.. Irvin based on his own actions opens the door of doubt in his defense.

Speaking again as a victim of a sexual assault myself (and being generous enough to assume there's some sort of merit to the woman's claim), I believe this woman has fucked over a lot of people by not reporting in a timely manner. She's fucked over herself, since she can't convict him. She's fucked over anyone else who might be threatened by Irvin. She's fucked over all other victims of sexual assault, who find it almost impossible to be believed in the public's eye or the legal system. And she's fucked over Irvin, since without any incriminating or exculpatory evidence available, a cloud of suspicion will hang over his head for the rest of his life.

I don't like Irvin as a person -- and I think he's an earsore of a sports commentator -- but I still believe he should be accorded the respect of having a fair day in court. After all the antics this woman has pulled, that will be impossible for him. There's no way for him to truly clear his name.

Not to mention, putting a negotiable price on a sexual assault as this woman has done . . . that nauseates me.

I think Michael Irvin has made a history of excercising poor judgement. Am I suppose to sit here and call out the character of the gutter whore and feel sorry for Sniffy? Fuck that! She's a golddigger, he's a chemically dependent dumbass, who has been given more chances than the prodigal son.

This is a non-story unworthy of the bandwidth.
