Respondent asserts that Complainant is incorrect in its classification of the word “total” as being “purely descriptive.” Respondent claims it is distinctive and the public is accustomed to seeing nonofficial domain names for NFL teams incorporating the “total” term (e.g., and ). Moreover, including the term “total” at the beginning of the Domain Name differentiates it from other domain names that not only incorporate the words “packer” or “packers,” but also begin with those words – e.g.,compare the domain names (; ; ; ; ; ) and the domain names (; ; ; ; ; ; ; ; ; ; ; ; ; ; and ).

If there's any doubt, we are not in any trademark dispute with the Green Bay Packers. I spoke directly to the Packers (May 2013) about this matter and they assured me that the site is in no shape or form in violation of copyright or trademark infringement. TotalPackers has been served a few times for copyright infringement, or maybe trademark ... maybe both ... TotalPackers have remarked on it a few times, laughing at it.

Curious, how did you stumble onto this?
