Porforis - Your insurance will cover your medical expenses. Since it's their fault, your insurance will reimburse you then charge the other party's insurance to get reimbursed themselves.

See your primary care doctor and then get his advice. He might recommend someone else. That's all covered. You'll probably have to pay it at first but KEEP YOUR RECEIPTS. You will be reimbursed.

I am an insurance agent in IL.
here is what I tell my clients-
1. Many/most companies use NADA as it is less than Kelly Blue book. They use the avg price for the car not the high value. If I remember correctly NADA only uses one value.
2. I would try and collect from the other company first not your own. If you use your insurance, your deductible will apply until they are reimburse from the other company. (They will subrogate and collect what they paid plus your ded.
3. Some companies, not all, try and low ball you and mail you a check. I won't name names but one of them that has done this has their headquarters in Bloomington,IL. SF.
4. Your medical is NOT covered by your own insurance. They will not pay and subrogate it back since you did not elect to have that coverage. You can turn it in to your health insurance but they will NOT pay either until they are certain that all auto coverage has been used up. You have none on your policy but they will expect you to seek reimbursement from the other carrier.
5. The other company will not pay for your medical bills until they know you are done with your treatment and are ready to sign off. It is a case of them wanting to know what they are dealing with. They will not just start throwing money into a hole if they do not know how deep the hole is. I have seen people need treatment for 2 or 3 years. The other company kept the file open but did not pay medical until my client was ready to sign off.
6. You are entitled to a rental but most companies do not volunteer to provide you with one because of situations like yours where you do not need one.
7. Everyone who has said so is right. GET CHECKED OUT. I was in an accident when I was 18. (On my birthday actually.) Guy pulled out in front of me. Wasn't wearing my seat belt (So long ago it was not the law.) Hit my head on the windshield. I went to the client on campus but did not get any xrays of my neck or back. 30 years later I am having problems with my back and arms. A chiropractor xrayed my back and even I could see the damaged vertebra and the calcium build up as they tried for 30 years to fuse themselves together. It was too late to have the other guys insurance pay me for the damage to my back.
My mom was in an accident at less than 5 mph and she got whiplash and has suffered with it for over 40 years.

8. I went thru this in a hurry and I know I am forgetting something so if you have other questions just ask me.

Did some searching for equivalent cars (same make, model, features) in the area, most of them fall within $400 (all higher) of the "Clean Retail" price on NADA (There's one with +30,000 miles vs my car at 2800 less than the clean retail, but no way that's got a clean history, it's a huge outlier)...

My car had no accident history, the only damage to it were a few scratches here and there. 99,000 miles if it matters. The only thing that would require any reconditioning in it if I were to sell it to a dealer would be on the interior, just shampooing the mats.

I will go absolutely bonkers if I get the "average trade-in" value, as I won't be able to get anywhere close to the same type of car that I had. I understand if I'm screwed out of the deductible and a little bit more (not that I think I should), but being screwed out of $2500 is absolutely ridiculous and unacceptable. What are the actual laws on what they're required to provide? I didn't find any specific verbiage in the paperwork I signed talking about what I should expect to get in the event of a totaled vehicle (which was confirmed).

As for medical stuff, my big problem at this point is finding a time I can go see someone. I work 8-6 shifts, and the next days I'll have off are Saturday, Tuesday, and Wednesday but I'll be out of town all of those days. Also, the back discomfort (not pain) I had this morning is gone, shoulder soreness is at a minimum and if not for the accident, it wouldn't be anything I'd think twice about. I obviously can't wait forever to see someone, but if I have zero pain or discomfort tomorrow with a full range of motion, would you bother?

Yes, you should bother.

You should know that you can build tolerance to pain to the point that you forget it.

Get checked out.

Portis, I had no pain later on that same day and my back is a mess today. I was going around 45-50 on impact so the odds are more likely that you will be alright. My mom had her head turned to watch traffic which is prob why she was injured.

Head to a walk in clinic if nothing else. In my case I was examined by a real doc but he did not look at my back at all just my head to see if I had a concussion.

I don't get involved in claims very often and it has been a little while since I have but I am pretty sure they will use avg trade in. (I forgot that NADA has multiple values. I think at one time they only had one. Which is why I like the Blue Book value.)

I have talked to adjusters on behalf of my clients many times and told them that the customer just did major work on the car. They just shrug and say that brings the car back to avg. New tires and so on mean nothing to them. I have even shown them what the cost of a like kind and quality car sells for in the area. They don't care as that is the starting point for a dealer. They can drop $1000 off the selling price in their next breath. If your car is above avg you have to prove it to them. Almost impossible to do so. But if you don't take their first offer they will move up a bit. They need to clear their desk of files and if you slow the process down they will try and work with you a bit.

FYI- most adjusters are not going to get worried about someone running out to get an attorney when it comes to book value on a car. The cost of the attorney is more than the extra value the claimant will gain in the process. They are concerned when it comes to medical bills as those go from next to nothing like yours most likely will be to tens of thousands of dollars in a hurry.

At some point you will need to decide if you can't get what you really want for a price what is the least amount you will grudgingly settle for? If they fall below that perhaps you do need to speak to a lawyer.

You have 2 companies with which to work. Usually your own company is quicker to offer you a good price for the car knowing that they will get the money back. (To a point. They can't give you $10,000 for a car that is only worth $4000 and expect to be reimbursed for that.) And I have seen the other company on rare occassion offer more than my clients company did.

If you feel you are being jabbed asked to move up the chain to someone else. Have solid reasons why your car is worth more than what they say and stick to them. Sometimes you need to go 2-3 people up the ladder. Keep in mind for the most part these suits will stand by their adjusters., If they don't then they don't need to keep them on the payroll so to speak.

No prob Zombie. It was an honest mistake. I have heard so many people say the wrong thing over the years I am use to it. Yours was a minor issue.

Yesterday's fun:
Claims adjuster can't provide me with a rental directly, not paying them for that on the policy. He determines liability and found me to be fault-free, but can't tell me for sure if my premiums will go up, need to talk to my local agent. Denied the other guy's claim for damages on his car since he was at-fault, I am not responsible for his damages from my company's perspective.

He did say the other company is required to reimburse me for rental costs, should hold onto my receipts and they can subrogate (sp) with the other company for those later.

I had to speak to a different adjuster (that was their total loss specialist) about what my reimbursement might look like, as the first guy said that they'd actually come to a dollar amount already. Spoke to her, she confirmed what the other guy said but couldn't talk to me about it as it was still waiting on supervisor approval. She pretty much dodged all my questions, so I guess I'll deal with her later.

Today, I went to clean out the last of the stuff in my car, get my plates, grabbed the gas cap for the sake of memories. Also, pix:

Yeah your company will not pay for a rental if you didn't have that coverage on your policy. I didn't elaborate since you said you didn't need a rental.

As to whether or not your rates increase, all adjusters should avoid talking about that. It is not their job.

Some companies have the "accident forgiveness" where they don't charge for the first loss. Technically even if Farmers doesn't have that, you will not be charged for an "at fault accident". I have seen companies not charge for that but take away the "claims free discount" since you had a claim and the rates go up even though it was not your fault.. Their argument is that they paid for a claim. That is why I prefer to try the other guy's ins co first. That plus not having to deal with the ded.

I only asked the first guy about that, I was mostly looking for information such as "how long is this going to take", "How much am I going to get" and "How likely is it that I will get my deductible back". Again, questions that I'm sure she wasn't allowed to answer yes but wanted to ask anyways.

That's pretty much what the first guy told me, made perfect sense.
