Uh, what? His first sentence is entirely accurate. Braun challenged the chain of custody, not the test results themselves. He never once disputed the scientific validity of the results. Your ad hominem is unwarranted.

Braun gains little with the DNA test if he and his (legal) team is confident that going a different route is a better chance to get him off the hook.

What's your point? The point is that nathaniel made a factually accurate statement, and Kevin jumped on him and impugned his integrity. I never said I agreed or disagreed with nathaniel's overall thesis, because I think that's beside the point. Regardless of what Braun's motives were for the strategy he adopted, I don't think Kevin's attack was was called for.

Braun never challenged the validity of the tests, which he could have done. He offered to take a DNA test to prove they weren't his samples, MLB said "OK", then Braun backed out.

Thus, he was not PERMITTED to speak directly about certain aspects of the results, such as validity. Did you not read his "lawyer speak" statement when it was first WRONGFULLY made public?

ESPN put Ryan Braun in a shitty position. They made public the results prior to his appeal being concluded and because HE obeyed the rules, he's gonna be blasted for it? Pretty ignorant and uncalled for if you ask me for my opinion.

Couple of random thoughts without barbs, but I shall preface it with this, I would not wager a penny either way if he did or did not have something in his sample. We don't have all the facts that were presented to the panel.

1) Braun was robbed of confidentiality.. unfairly.

2) We don't know the timing of the DNA test offer and whom really didn't want to follow through with it.

3) Braun's team went through the process step by step and attacked every link.

4) How is he really suppose to challenge the test itself if something improper happened with the sample?

5) Explain why MLB isn't talking about the "B" sample and what it showed? Or why Braun isn't talking about it for that matter.

6) 25 clean tests to one with some handling problems.. I think the panel made the right call in overturning this one. Plain an simple, written protocol to operating protocol varied.

7) I think sports as a whole have a ways to go in the testing process to truly weed out PED's and provide some protections to players in general to ensure privacy and due process before there careers are brought into question.

8) I do believe this story is not closed yet.. and honestly as a Brewer fan, I don't know that is a good thing.

I want to believe that Braun is completely innocent, but we have heard those adamant words of denial before. Personally, I choose to believe his innocence until proven guilty. Not in reverse.

MLB fires arbitrator from Braun case

Major League Baseball management has fired Shyam Das, the arbitrator who overturned Ryan Braun's drug suspension in February.

MLB informed Das and the players' association of its decision last week. Das had been baseball's permanent arbitrator since 1999, part of what technically is a three-man panel that also includes a representative of management and labor.

''Shyam is the longest-tenured panel chair in our bargaining relationship,'' union head Michael Weiner said. ''For 13 years, from the beginning to the end of his tenure, he served the parties with professionalism and distinction.''

Baseball's collective bargaining agreement says the arbitrator can be removed by the players' association or management at any time with written notice.

The sides will now try to select a successor. If they cannot agree, baseball's collective bargaining agreement calls for them to ask the American Arbitration Association for a list of ''prominent, professional arbitrators.'' The sides would then alternate striking names from the list until one remains.

This means Ryan Braun was guilty and should be banned from Baseball like Shoeless Joe. I'm saddened and disappointed. I'm going to burn my Ryan Braun jersey this weekend using tears of disappointment as lighter fluid.

Didn't say anything back then, but there are reasons for "chain of custody" and other courtroom rules of evidence.

They usually aren't just technicalities. They are there because the details can really matter; and in a trial courtroom, as opposed to the "court of public opinion," the evidence doesn't just get let in based on who might be able to finagle access to a mike or a blog.

I have no idea whether Braun did or didn't. But I do think anyone bases their weighing of evidence of this sort by trying to perceive the truth of the matter via public babblings of talking heads and sports personalities not constrained by state/federal rules of evidence ... well, I think you're a pinhead. Or to quote the eloquence of DakotaT...you're a dumbass.

And do not be conformed to this world, but be transformed by the renewing of your mind, that you may prove what is that good and acceptable and perfect will of God.

So if the Fed Ex offices are closed after 5 pm on a Saturday why didn't MLB and the PA have it in writing that they did not want any samples taken after noon on Saturday until 9 am on Monday? If they were a little clearer in their instructions there would not be a second one of these improperly handled cases this year.

Which brings up another issue, different substances have longer/shorter shelf life in the body. I wonder if some players have learned if they take a substance on Friday afternoon that the residue will be gone by Monday morning?
